The rights to the songs on the three records belong to Capitol Records right? How about the stuff released by Nel that one Christmas and the stuff like Mother and other songs that were never on any of the three records? I ask because I am doing a power point presentation and I wanted to do it on Shannon and use some of his songs, but as part of the course the instructors tell us to avoid any copy right materiel, unless we secure the rights. (They suggested from a friend or doing a cover. I dont know anyone who's in a band that would over a song for me, and I cant' play anything.) Should I just use something free I find online and avoid the songs to be safe? I don't have the funds to pay for the rights just for a school project that may or may not be put online somewhere.

Hmmmm. . . I'm not sure what advice to give. In trading circles, I would venture to say that anything outside of the official releases is fair game as long as money is not exchanging hands.
I understand why your teacher says its an issue though. Giving public speeches is kind of like publishing in a way. And you need to make sure to not say someone else's words or present their material as your own. Of course, I am sure you wouldn't be mis-representing it in that way.
How about this. . . Blind Melon gave its blessing to archive.org that allows traders to upload unofficial material that is not being bought or sold. So in a very general sort of way, they gave permission for the un-official material to be traded. The parameters they gave the melon community was to just stay away from trading the official recordings. If Blind Melon had not given their blessing for traders, then their material would not be allowed at archive.org.
That's the best angle I can give you to approach your teacher with. But at the same time, I think your teacher is just probably trying to address the issue of sourcing information and the boundaries that exist with that. No matter what happens, I would say that the big suits from Capitol will probably not show up to break your knee caps if you use official material in your presentation.

If the band gave permission, is that not enough?, because Capitol holds the rights to the music? I don't know how it all works. Can't the band or Nel just say "go ahead"? Shannon passed & Nel holds those tunes she released. Capitol or even the band can't stop Nel from saying what can & can't be done....can they? As you can see here, I have more questions than answers haha. Oh well, trying to help.

Copyright laws are complicated. It is just a school project, but if I were to upload it to youtube or place it in my portfolio or do some other sort of public self-promotion the record label might say "Hey. Where's our money?" Then again, I won't be using it for a profit. But as for the band and Nel giving permission, that's why I asked about the songs that weren't officially released. I figured if I'd get any answer anywhere it'd be here. Worse case scenario I'll just play it safe and not use any BM music, unless I find a suitable cover tune. Ryan- Thanks for the info. I wasn't as worried about the band members getting huffy, It seems that as long as you are doing it with good intensions and respect Shannon and the band they are cool, but it's always polite to ask.

I agree with Ryan that it should be safe to use any live Blind Melon music from archive.org.
In my opinion, as long as it is used in an educational classroom setting, you are not making money off of it, and you are giving proper credit you should be fine.
When Glen held that video contest a few years ago he gave permission for us to use any Blind Melon footage we had. Videos from that contest have been uploaded to youtube, myspace, etc. and as far as I know nobody has gotten in trouble for using any previously released footage.
