If they contact Ebay can they file a claim for fraudulent materials and get their money back?

Yes... As long as they paid via PayPal.
If they paid with a check or money order, the seller could refuse.. and the buyer would be screwed. But, I do believe, if that happens, eBay warns the seller or suspends their account.

Yea, it sold for the "Buy It Now" price of $33.33 ... I sent the seller a message. Not that it matters. I guess you are allowed to sell whatever you want on Ebay these days. It's pretty sad that folks out there will let themselves get ripped off like that. I guess if your not going to educate yourself on what you are buying then you don't need your money that bad anyway.

6 CD's for $33.33, sounds like a good deal to me. Do you realize how long it would take someone without high speed internet to download them, burn them to disc and make up the cover art for the cases? I just don't get what the problem is. Whoever bought them is going to love them and the seller isn't getting rich off it.
The best solution to this "problem" would be for them band to officially release more live recordings regardless of the sound quality. Something is better than nothing.

However, they should not misrepresent what they are selling. He put on there "From My Masters" or something to that effect. I mean, I guess they are from his "masters" that he downloaded but these things are being sold as something more official. Another way to look at it is, why not just trade free killer Melon shows with other Melonheads instead of trying to make a buck off it. Don't kid yourself into thinking that this person is doing folks a favor by putting this together. The only purpose of selling on ebay is to make money.

I'll agree with you on the misrepresenting by calling it "his masters", that would matter if they were tapes but in the digital age the generation of the copy isn't that important (I think this is what the seller meant by that comment. Is he doing this to make money? Sure, but it isn't going to be much considering the time and hassle involved so that really doesn't bother me. It bothers me more that some people here have a mob mentality and feel the need to "attack" him, for lack of a better word. If it bothers you that much channel that negative energy into a positive solution, create an auction selling the same thing at your cost. When buyers bid you can e-mail them and let them know where they can download it for free, if they have no means to download then you can be a "good" melonhead and burn them a copy.
