okay so i'm posting this right now first off i havent been on here in a long time, mostly cause i just got busy with life, and didnt have time for this kind of shit anymore, but someone told me that this particular thread had popped up and i had to try to set the record straight.
this colin that you all are referring too, isn't the colin from canada that your probably remembering meredith. i can 100% assure you of that, and i think it's completely ridiculous for anyone to make that assumption about a person without knowing for sure first. to be fair, i'm not attacking you meredith, i realize you were just asking if it was him, however it's totally unfair to make assumptions or alienate people in such a way.
Part 1Well from a well informed resource who is a lawyer, and also in university for this type of law. (Here is some things to consider, and I will explain why its all broken down. If it is too detailed, long, and boresome; I am sorry. Its here for you to understand that maybe selling Intimate and Interactive on Ebay isn't illegal.
We have
Stations that show programs through different
media outlets Few stations are owned by public interests, and if they are most of the time it is solely in the governments power to legislate there powers over the station.
HBO is an example in America of a station owned privately, and no involvement from the government, (they fall into the few category).
The classification in this type of viewing is payper view, because in some part you have purchased it, (albeit through your satellite or cable provider)
Most stations are
run, regulated and funded in some part by the government, and though there ownership by a company, the governement has the most jurisdiction and final say in programming, Not ownership as much, however, unless your MUCH TV, (the program that showed Intimate and Interactive, more government ownership).
Media Outlets
Many media outlets are privately owned, by individuals, corporations, or big media conglomerates (basically anyone who is really rich can own one), secondary to that is
sister stations who buy the rights to show a program. *(Secondary stations are mentioned here because they are often times small enough that they are owned by individuals or companies, and are like media outlets they have about the same guidelines they have to follow but the degree and extent they are regulated by the government is far and inbetween.
An example is like ITV station in England, where a
PRIVATE INDIVIDUAL can acquire a piece of footage
LEGALLY if they have signed a contract that details the
TERMS OF USAGE through ITV, because
ITV owns there shows.
For the individual you purchase a show you like, and through a signed contract its yours (very heavily stipulated, but the make most of there long outdated programs still available). In this situation ITV is much like HBO and they will sell you shows, and they own a 100% of the rights because they in part have bought the shows from the media companies they are affiliated with, and/or own.
(Meaning its illegal to put it up as a torrent, rapidshare, or youtube link, but you can purchase)
Some media outlets however, are owned privately, but government has there hand and control in what is shown on that station as well as ownership of programs.
EX. CTV
This is where I explain the government involvement. Its not important for the most part in many cases, because usually one of the two,
MEDIA OUTLET or
STATION owns the show, but in some particular cases it actually is owned by the
GOVERNMENT.Government at one point owned all the stations, controlled all the viewing we had.
This is where Much Music, or CHUM T.V. is the subject of banter.
ARE RESELLING THE SHOWS ILLEGAL?Much Music (CHUM TV) was/ (Not sure about now), but
was owned in part by Moses Znaimer (http://www.mosesznaimer.com) He is in control of programming thats about it.
Now if Much Music was like the ITV channel (privately owned station) or HBO (many of us who wanted a long outdated show like Much Musics I&I could certainly purchase a contract through them, and they would do it, or would certainly help you with the resources, or explanations in how, where, and all the questions of obtaining a copy)
However,
Much Music has
ownership by the Canadian government as well
Heres the breakdown:
Much TV is owned by CTV Globemedia (2006)
CTV (Canadian Television) CTV is owned in large part by the Canadian government so not only regulated by the government, but also owned, and in control in most of the legal aspects. CRTC also has there hand in this equation. Much music being the subsidary of Globemedia has no control over most of there content suffice to say, and more ownership is entitled to the canadian government
(This is unlike CBC Canadian Broadcasting corporation which is a public funded program by Canadian tax payers, and thus the viewer certainly can obtain programs in some way or another, through the station, and its media outlets; or last resort through stock footage companies, historical societies, and other insitutions or companies who are affiliated with them)
Therefore if it was on CBC we all win
we can see it or obtain in someway. Shown through CTV Globemedia or through the whatever ownership was way back in 95' (still government owned) we are all screwed unless we can get a copy through some way or another .
Part twoAfter reading that here is some things to discuss:
When you put a blind melon picture on the forum. DO you OWN that picture? Probably Not!!! Did you write to the photographer asking for the expressed written consent of the usage? Most likely not either. Did you own the copyrights to the moving stills that were used in the production of that cover for I&I?. Probably not as well. See where you are taking this.
Now, a step further when someone puts up a rare Blind Melon video on youtube, and he doesn't own the rights to that video, (and most often is up there for a limited amount of time) are you entitled to copy it off there using
www.vixy.net How about when people send links and the go in blogs, forums, chat rooms to get it.
I see Intimate and Interactive on youtube as well as traded, and sold on Ebay (not just this one time), and other traderslist (yes some people I know do this). Most of these people are law abiding citizens however, and they aint selling Live at the Metro (which is a damn shame because the pay per view show which could be obtained by JBTV in Chicago at one time, had an excellent interview).
My feelings are this:
I support Blind Melon 100% even though like MANY others I got a version of 'For my friends', before it was released; (I DON'T PROMOTE STEALING MUSIC ILLEGALLY), and I still went out and
bought the record.Matt, I understand your looking out for the band, and I don't know what the breakdown is for the band royalties. I certainly want them to be rich; no qualms with me, but often the richest resource is not in people who trade, but other places like youtube and torrents, and other means such as Ebay.
I would be pissed if someone put up something I owned and i was losing money off, we all would.
WE ALL UNDERSTAND THAT.However, to my knowledge
No one owns the Intimate and Interactive show, further discussion would be if Capitol Records, or Much Music would make it available with further interest. see MTV and the Woodstock show. At this moment in time its free on youtube, and sold on ebay. Most videos are only one or the other, so since the powers that be haven't said much - means more than likely there is no one getting ripped off, exluding the fact that most have probably no knowledge of where to get a physical copy of it.
Here is some other inquisitions:
One show taped in Hilversum studios - the meter sessions. I seen it on rapidshare and then it was taken down. I found it on music stack and bought it. I know its on youtube now...
(Sue me for not knowing the proper methods of obtaining this show - if i didn't belong to a forum, and/or also choose not to. Did i feel ripped off NO, do i feel ripped off by getting a copy of greg pratos book and paying over a $125.00 for an advanced copy; when now i see it on Ebay for cheap. Yes I do. I know the bids on the I&I started at 0.99 when i first seen it and it went to 20.00 I would say if it stayed at 0.99 and had a Buy it now at 5.00 I am not against. Thats where I can't understand someones anger. Making something available, and cheap @ 5.00 good on them, making it more expensive depends on the rarity of it.
Now does this mean Matt, with the so called illegal bootlegs out there - you are the sole propeitor for making copies? If so then perhaps through you or the band should make an easily found and accesible website (beyond the forum), so fans and/or the band both don't feel like there ripped off in situations like this. (Many bands who have had long established careers make sure you know what shows are reproductions, and bad quality bootlegs, and work on availabilty for shows that fans want; is this is a possible suggestion)
In the end here is my understanding, If the show was released officially and traded I would be
All against it, If the show was written off as another show (ex. Commodore ballroom passed off as I&I), again
PISSED. If the show or anything for that matter was to be released eventually, and someone stole it, made it available - you guessed it I would be
PISSED.
However if the show was not released, and no one was getting ripped off to my knowledge, and the person selling it wasn't gouging anyone with price. Then I am totally happy for him, wish I would have thought of it first.
He is selling someone something that is free, and not illegal.Now answer this melonheads you get a video that is a compilation of Blind Melon on numerous shows, and you never seen them. Everything is on there you ever wanted to see - MTV most wanted, Raw Power, MTV beach house...hell ya, show me more!!!, however someone put 'Live at the Metro', and your reporting the guy. Well to me that is the real sour grapes part you just ruined someones experience of seeing something new and different, beyond all the official stuff out there.
