I appreciate the time and effort that was put into your post. Lots of pros and cons listed.
a couple of things that i wasnt sure where you were going with them were as follows:
* If i put a picture up on a website, or i put a video up on youtube... i'm not selling it. therefore that part of your post kinda got tossed out the window to me.
* though you acknowledged that Merideth was just ASKING a question, you also stated that it was ridiculous to jump to her assumption. --- i disagree, shes been around the melon community for a long time, and evidentally there was someone named Colin that was doing this on a prior occasion. So its NOT out of line to automatically wonder if its the same person, and therefore, ASK.
* From your post, i get the impression that i could record a television show, and provided that the season of that show isnt for sale yet in the stores, i could burn copies and sell them. I beg to differ... SOMEONE owns the copyrights to that show. and if NOT.... what about the material contained on it. SOMEONE (namely blind melon) owns the copyrights to those songs....correct? therefore, wouldnt it be selling copyrighted material that you are NOT the owner of. (this part wasnt cleared up in the post.. and i'm just questioning).
NONETHELESS: EBAY rules for RECORDABLE MEDIA
Only copyright owners, or the copyright owners’ licensees, are permitted to list their products copied onto recordable media (such as VHS tapes, Audio tapes, CD-Rs and DVD-Rs) on eBay. Sellers listing any type of recordable media must state their copyright ownership or license to resell these items in their listings.
of which the I&I would qualify as a rule breaker, and not be able to be listed as an e-bay item. (not saying that we have cleared up whether it could be sold elsewhere)
I do agree with the fact that the PURCHASER has named their price... and providing they get what is advertised.... is NOT going to be complaining about having something they didnt have. I myself bought 6 or 7 Blind melon "silver cd's" back in the day from my friends record store. $20 or so a piece. NOW that stuff is available for free trade. DO i feel ripped off. NO. I enjoyed 16 years of Melon imports/bootlegs before i even came across this place.
now... to mix up MY take on the whole thing even more... If say, i was just a casual music listenger had a long time ago had gotten ahold of one of the random live shows, and it had ~MATTS~ artwork .... lets say i'm cleaning out my cd collection and getting rid of stuff and really didnt listen much to B.M. i wouldnt have seen the harm in selling it to get rid of it to someone that would appreciated it. -- not that its right. BUT, mass producing them to sell to grub cash?? i dont like. and UNFORTUNATELY... it comes down to it being a case of MORALS in that situation.
but LEGALITY is the question ... and i myself am still kinda stickin with the ILLEGAL opinion, because that person that is sellin it DOESNT own the copyrights to the broadcast, nor the content.
WAKE UP... i'm done typing now.
